A member from the producers’ side of the fence (if you will) says a strike by ACTRA would be considered illegal, and would go to court in Ontario to fight it, should a strike happen.
In the event of a strike on Monday, [John] Barrack said the producers’ association will seek to have the action halted in an Ontario court, and to have an arbitrator determine such fundamental questions as whether ACTRA members are legitimately represented by the union and whether the strike’s timing is legal.
Because performers are considered independent contractors, there is an “open question” whether they are members of a union or an association, or even whether a legal collective agreement exists, Barrack said.
That is a matter that could take an arbitrator some time to rule on, he added.
The ACTRA side contends that ACTRA is a legitimate trade union “for the purposes of collective bargaining”, that it “has been tested in Ontario” already.
